          Personal Injury FAQ's

We take the stress out of the legal process by working on a contingency. There are absolutely no out-of-pocket costs for you, we only get paid if there is a settlement, and in that situation, we take a percentage of the settlement.
Insurance companies are likely to offer you less without an attorney representing you. We have recovered millions for our injured clients.
You may be asked to provide details of your accident to your insurance company. The details you give to you give them may determine whether your insurance claims are successful or not.
Depending upon the circumstances of your injury, your medical insurance may or may not be willing to pay for your treatment. We have access to many medical resources that can be paid for out of your settlement. For example we may be able to pay for your medical treatment with, Uninsured or Under-insured coverage for Auto Accident Claims and for Premises Liability Claims, Homeowners Insurance and Business Insurance may be used on a case by case basis.
Our Free Case Evaluations generally take approximately 10 minutes. During the free consultation, we will listen to the circumstances of your accident, answer your questions, then provide you with an opinion on the strength of your case, as well as next-step options you may wish to consider. If it is determined that we can help, we will set up a mutually convenient time to meet with you. Meetings may be held either in our offices or, if you are too injured to travel, we will come to your home, office or the hospital at your convenience. Consultations are always complimentary and always informative.
This is one of the most commonly asked questions. It really depends on factors such as the type of accident, the insurance company involved, and the degree of medical care needed. During your Free Case Evaluation we can generally provide a better time estimate, however every case is different.

How much is the fee for an injury lawyer?

Despite what most believe, injury lawyers can be hired with no upfront payment. Most personal injury lawyers work on contingency fees instead. This means that they will receive an agreed upon percentage of the awarded settlement, if and when you win the case. Contingency fees are usually about 33% of the total awarded settlement. If you don’t win the case, you may not have to pay – but agreement terms can vary. There can be other fees associated with the case, that you’ll have to pay whether you win or lose. Before taking legal action you should ask your attorney for an estimate of fees, win or lose.

Will I get more settlement money with a personal injury lawyer?

Proven time and time again, hiring a San Diego injury law firm is a wise investment – that might not even cost you anything (unless you win). Between the financial compensation and time savings, personal injury lawyers can help maximize a settlement. If you’ve experienced an incident that calls for a personal injury attorney, chances are you deserve compensation. A comprehensive study by the Insurance Research Council showed that representation of a personal injury lawyer resulted in nearly 3.5 times more money, even after the contingency fee was paid.

How are personal injury settlements paid out in California?

So you’ve won a personal injury settlement in California, now what? In most cases, you’ll sign a settlement release form which your lawyer will send to the liable party’s insurer. The insurer can then disperse the settlement check payable to you. Although the check is payable to you, it’s usually deposited by the lawyer into an Interest on Lawyer Trust Account until outstanding medical bills are paid or settled. Liens need to be paid before settlements can be received. Once liens are satisfied and other fees (including the attorney’s fee) are deducted, your attorney should have you sign a breakdown of expenses. Upon signing, you can expect your settlement check to be released to you shortly after. Personal injury settlements in California can either be structured or lump-sum. Structured settlements mean guaranteed periodic payments will be received. Lump-sum settlements allow the full settlement to be received at once.

Is No Win, No fee worth it?

No win, no fee lawyers usually only take cases they are passionate and confident about fighting. For those that have been wronged but don’t have financial resources to hire any lawyer in town, no win no fee lawyers are a valuable resource. Even if you do have the funds, you can still use a no win no fee lawyer. Essentially, a no win, no fee lawyer has a guarantee that the client will not pay for legal representation unless the claim is won. If the claim is won, compensation will be deducted as a percentage of the settlement amount won. However, there may still be court fees and other fees associated in the event your claim is unsuccessful.

Why do most personal injury cases settle?

As we all know – time is valuable. And, with most fearing the unknown, settlements are a common outcome for personal injury cases. If the case goes to trial, the outcome can be unpredictable. If the case is valid and truthful, the defendant will often settle to save time and potentially money too. Settling is a much faster and easier process.

          What is personal injury law?

Personal injury law covers cases where a victim experienced injury or accident and takes legal action against the wrongdoer responsible for the harm caused. Note that personal injury cases have a statute of limitation of two years, starting the date of the injury. If you believe you have a personal injury case, get on the phone with San Diego Injury Law Center as soon as possible. After all, the phone call costs you nothing and if you win, it could win you a settlement to help you recover physically and financially.

Who can I sue for my injury?

For personal injury cases, you can sue the entity or individual that caused the harm. For example in an auto accident, you could sue the driver at fault. For a slip and fall accident in a retail store, you could sue the store. A personal injury attorney can help you determine who the right party is to sue.

How much is the fee for an injury attorney?

Fees for an injury lawyer can vary. A majority work on contingency fees, so their total fee will be a percentage of the total settlement awarded. There are usually additional court fees as well so check with your attorney for a breakdown of what fees to expect, win or lose. If an attorney works on contingency fees, but does not win the case, you should not have to pay any contingency fees. Clearly read any contractual agreement before hiring the attorney.

What percentage do most injury lawyers take?

Most lawyers will set their fee around 33% of the total settlement amount, but fees can vary. Remember, the attorney that will work for the least amount of money is not always the best option. When shopping attorneys look for qualifications, reviews, past cases, expertise, and so forth. Yes, the fee matters but you want to choose the right representation first.

How long does a personal injury case take?

Personal injury cases can vary, but most can be resolved within 6-12 months of the original accident date. However, some may take longer. In most cases, the victim will need to receive medical treatment and once complete, the attorney can submit a pre-litigation demand. In some cases, it may take longer to close the case, which is why we encourage victims to contact an attorney as soon as possible following the accident. There is a statute of limitations of two years for personal injury cases in California.

How Much Money Can I Get For My Injury?

The accident and injuries will impact how much money you can get. You’ll want to make sure you sue for the appropriate amount, which is where an attorney can help. A personal injury attorney can help ensure no money is left on the table. Plaintiffs do not have a maximum limit they can sue for compensatory damages in California, with the exception of medical malpractice suits which have a $250,000 limit of pain and suffering and additional non-economic damages.

In California, most personal injury cases end in settlement with an average amount of approximately $21,000. Cases that go to trial end with an average verdict of $114,305. For wrongful death cases, the average verdict in California is higher than the national average of $1,450,000. In California the average wrongful death verdict is $2,212,936. With about 41% of personal injury cases awarding the plaintiff, consider carefully before passing up a settlement to go through trial.

The insurance company just offered me a settlement and I need money now should I take it?

Circumstances can vary. The best thing to do in this situation – no matter how desperate – is to contact a personal injury attorney. Insurance companies want to maximize savings so they may be doing you a disservice by offering you a settlement. For personal injury expert advice in California, contact SDInjuryLaw for a free consultation.

Can I just handle my own personal injury case and not use a lawyer?

While you may be able to handle your own case, you are doing yourself a disservice by not seeking the help of an experienced lawyer. To avoid loss of compensation and months of frustration, enlist the help of an attorney – you’ll be glad you did.

How much should I sue for my pain and suffering?

The amount of compensation you can sue for will depend on the facts related to your case. The best way to get this question answered realistically and accurately is to consult with a personal injury attorney

          • Car Accident Cases
          • Car accidents can cause injury and harm – and you may not always realize just how impactful the crash was until a bit down the road. In California alone there are nearly 200,000 automobile accidents annually that leave individuals injured. If we include accidents where no injuries occurred, reported and unreported, we’d see this number reach over half a million. Most car accidents in California are the result of negligent or reckless behavior such as driving under the influence. speeding, or distracted driving. In a personal injury case if you can prove negligence, you easily have a viable case. If involved in a car accident, seriously injured or not, you can consult a personal injury attorney. Contact SDInjuryLaw now for a free consultation.
          • Motorcycle accident cases:
          • Motorcycles are extremely popular, especially in places like California with high gas prices, congested parking, and nearly perfect weather year round. In California, studies compared the number of motorcycles on the road in California, compared to the rest of the country. Studies show that there are more motorcycles (approximately 800,000) on roads in California than any other state. Sadly, almost 12,000 people are injured annually as the result of a motorcycle accident in California and nearly 500 are left dead. Motorcycle accident injuries commonly leave cyclists with injuries to the lower extremities and to the chest and head. If the accident involves a car or truck, injuries can be more severe. Injuries can include traumatic brain injury, broken ribs, whiplash, broken or amputated limbs, and so forth. Injured in a motorcycle accident? Contact SDInjuryLaw, motorcycle accident attorneys in San Diego.
          • Truck accident cases
          • Semis, Big Rigs, and other trucks help make the world go round, but they do present a hazard for drivers on the road. In California, there are nearly 113 fatal truck crashes on average annually with nearly 3,000 truck accidents resulting in injury. With California’s congested roads and high cost of living, many of us spend a good portion of our day on the freeway battling traffic and dodging trucks. While we must all look out for one another on the road, accidents happen. For more information about a personal injury attorney that can help with a truck accident claim, contact SDInjuryLaw
          • Brain Injury cases:
          • Brain injuries can have devastating effects. Some effects may take a while to surface so we encourage victims to seek medical assessment after any accident, small or big. Traumatic brain injury (TBI) is a common injury of personal injury accidents. To prove TBI, a CT scan or an MRI can be used. In the United States in 2019, the CDC reports nearly 61,000 deaths resulting from TBI alone. While TBI does not always result in death, it can leave patients with long-term health problems. TBI cases deserve legal representation to get the justice deserved. If you’ve suffered TBI as a result of negligence, contact SDInjuryLaw now.
          • Dog Bite Injury cases
          • Our four-legged friends are not always so friendly. As a result, dog bite injury cases are a common occurrence in California. In fact, California is ranked number one for the most dog bite claims. You may be wondering ‘how much can you sue for a dog bite in California’ among other questions, for personalized answers contact SDInjuryLaw now.
