How much is the fee for an injury lawyer?
Despite what most believe, injury lawyers can be hired with no upfront payment. Most personal injury lawyers work on contingency fees instead. This means that they will receive an agreed upon percentage of the awarded settlement, if and when you win the case. Contingency fees are usually about 33% of the total awarded settlement. If you don’t win the case, you may not have to pay – but agreement terms can vary. There can be other fees associated with the case, that you’ll have to pay whether you win or lose. Before taking legal action you should ask your attorney for an estimate of fees, win or lose.
If you’re in the San Diego area and need the advice of a personal injury lawyer, the San Diego Injury Law Center can help. We offer free consultations to determine if you have a viable case and you pay nothing until we win your case. Call us: 619-338-8230
Will I get more settlement money with a personal injury lawyer?
Proven time and time again, hiring a San Diego injury law firm is a wise investment – that might not even cost you anything (unless you win). Between the financial compensation and time savings, personal injury lawyers can help maximize a settlement. If you’ve experienced an incident that calls for a personal injury attorney, chances are you deserve compensation. A comprehensive study by the Insurance Research Council showed that representation of a personal injury lawyer resulted in nearly 3.5 times more money, even after the contingency fee was paid.
How are personal injury settlements paid out in California?
So you’ve won a personal injury settlement in California, now what? In most cases, you’ll sign a settlement release form which your lawyer will send to the liable party’s insurer. The insurer can then disperse the settlement check payable to you. Although the check is payable to you, it’s usually deposited by the lawyer into an Interest on Lawyer Trust Account until outstanding medical bills are paid or settled. Liens need to be paid before settlements can be received. Once liens are satisfied and other fees (including the attorney’s fee) are deducted, your attorney should have you sign a breakdown of expenses. Upon signing, you can expect your settlement check to be released to you shortly after. Personal injury settlements in California can either be structured or lump-sum. Structured settlements mean guaranteed periodic payments will be received. Lump-sum settlements allow the full settlement to be received at once.
Is No Win, No fee worth it?
No win, no fee lawyers usually only take cases they are passionate and confident about fighting. For those that have been wronged but don’t have financial resources to hire any lawyer in town, no win no fee lawyers are a valuable resource. Even if you do have the funds, you can still use a no win no fee lawyer. Essentially, a no win, no fee lawyer has a guarantee that the client will not pay for legal representation unless the claim is won. If the claim is won, compensation will be deducted as a percentage of the settlement amount won. However, there may still be court fees and other fees associated in the event your claim is unsuccessful.
Why do most personal injury cases settle?
As we all know – time is valuable. And, with most fearing the unknown, settlements are a common outcome for personal injury cases. If the case goes to trial, the outcome can be unpredictable. If the case is valid and truthful, the defendant will often settle to save time and potentially money too. Settling is a much faster and easier process.
What is personal injury law?
Personal injury law covers cases where a victim experienced injury or accident and takes legal action against the wrongdoer responsible for the harm caused. Note that personal injury cases have a statute of limitation of two years, starting the date of the injury. If you believe you have a personal injury case, get on the phone with San Diego Injury Law Center as soon as possible. After all, the phone call costs you nothing and if you win, it could win you a settlement to help you recover physically and financially.
Who can I sue for my injury?
For personal injury cases, you can sue the entity or individual that caused the harm. For example in an auto accident, you could sue the driver at fault. For a slip and fall accident in a retail store, you could sue the store. A personal injury attorney can help you determine who the right party is to sue.
How much is the fee for an injury attorney?
Fees for an injury lawyer can vary. A majority work on contingency fees, so their total fee will be a percentage of the total settlement awarded. There are usually additional court fees as well so check with your attorney for a breakdown of what fees to expect, win or lose. If an attorney works on contingency fees, but does not win the case, you should not have to pay any contingency fees. Clearly read any contractual agreement before hiring the attorney.
What percentage do most injury lawyers take?
Most lawyers will set their fee around 33% of the total settlement amount, but fees can vary. Remember, the attorney that will work for the least amount of money is not always the best option. When shopping attorneys look for qualifications, reviews, past cases, expertise, and so forth. Yes, the fee matters but you want to choose the right representation first.
How long does a personal injury case take?
Personal injury cases can vary, but most can be resolved within 6-12 months of the original accident date. However, some may take longer. In most cases, the victim will need to receive medical treatment and once complete, the attorney can submit a pre-litigation demand. In some cases, it may take longer to close the case, which is why we encourage victims to contact an attorney as soon as possible following the accident. There is a statute of limitations of two years for personal injury cases in California.
How Much Money Can I Get For My Injury?
The accident and injuries will impact how much money you can get. You’ll want to make sure you sue for the appropriate amount, which is where an attorney can help. A personal injury attorney can help ensure no money is left on the table. Plaintiffs do not have a maximum limit they can sue for compensatory damages in California, with the exception of medical malpractice suits which have a $250,000 limit of pain and suffering and additional non-economic damages.
In California, most personal injury cases end in settlement with an average amount of approximately $21,000. Cases that go to trial end with an average verdict of $114,305. For wrongful death cases, the average verdict in California is higher than the national average of $1,450,000. In California the average wrongful death verdict is $2,212,936. With about 41% of personal injury cases awarding the plaintiff, consider carefully before passing up a settlement to go through trial.
The insurance company just offered me a settlement and I need money now should I take it?
Circumstances can vary. The best thing to do in this situation – no matter how desperate – is to contact a personal injury attorney. Insurance companies want to maximize savings so they may be doing you a disservice by offering you a settlement. For personal injury expert advice in California, contact SDInjuryLaw for a free consultation.

Consulting with a personal injury attorney is always worth it following an accident. Especially, since consultations are free with SDInjuryLaw in San Diego. If they feel you have a case, use professional legal representation to pursue it. Justice is deserved, and an attorney can help you get it.

Sadly, almost 12,000 people are injured annually as the result of a motorcycle accident in California and nearly 500 are left dead. Motorcycle accident injuries commonly leave cyclists with injuries to the lower extremities and to the chest and head. If the accident involves a car or truck, injuries can be more severe. Injuries can include traumatic brain injury, broken ribs, whiplash, broken or amputated limbs, and so forth. Injured in a motorcycle accident?
